TERMS OF SALES

The conditions set out below define the rights and obligations of the ANJALI MOONRISE brand as well as of the buyer, hereinafter referred to as “Customer”.

It is specified that the Products are reserved for individuals and are intended exclusively for personal use. Under no circumstances may the Products be subject to professional use by the Purchaser.


The customer declares to have the legal capacity to conclude this contract, that is to say to have the legal majority and not to be placed under a legal or conventional protection regime, according to the article of law 1146 of the Civil Code.


The site www.ANJALIMOONRISE.fr reserves the right to change these conditions at any time, without notice. However, any changes will be mentioned in these general conditions of sale.


For the application of the present, it is agreed that the Customer and ANJALI MOONRISE will be collectively called the "Parties" and individually called a "Party", and that the Customer having validated an order will then be called "Buyer".


ARTICLE 1: FORMATION OF THE CONTRACT


The formation of the contract between ANJALI MOONRISE and the Customer occurs at the time of the order confirmation. This order confirmation summarizes the details of the order and serves as a contract between the parties.


All the products listed on the ANJALI MOORISE website are available for delivery to all countries served by the Post Office.




ARTICLE 2: ORDER TERMS


The site www.ANJALIMOONRISE.fr allows you to order a selection of products immediately online via the internet for delivery to all countries served by La Poste. The ordering process is established as follows: the Customer can add a product to the basket at any time by clicking on “add to basket” via the product sheet. The product is then added to the basket and the Customer can continue his visit to the site to add other products. The Customer has visibility on the contents of the basket with the prices and characteristics of the products by clicking on "see my basket". He can then finalize his order by clicking on "pay my purchases".


For an order to be fully validated, the Customer must identify himself clearly by creating a customer account where he must enter his name, first name and email address which are exclusively personal to him.
To finalize his order, the Customer must have validated the general conditions of sale, as well as the confidentiality policy by checking the box provided for this purpose; he must give his billing and delivery details; he must choose the delivery method for his order; he must select his means of payment; he must then validate the order. The order is validated once all the fields have been completed by the customer.


To avoid any errors, ANJALI MOONRISE recommends that its Customers carefully check the content of their order (product, price, option) before confirming it, it will be possible for the Customer to repeat this verification during the receipt email confirming the order. . The Customer will have access to his order via his personal space on the site in the “history and details of my orders” tab.

ANJALI MOONRISE reserves the right to refuse, cancel and terminate orders at any time for legitimate reasons. For example in the event of an ongoing dispute concerning the payment of a previous order or if ANJALI MOONRISE suspects a violation of the general conditions of sale or for any attempted fraud.

ARTICLE 3: PRODUCT


All orders placed through the website are shipped subject to product availability.
ANJALI MOONRISE makes every effort to ensure that the products offered on the website are available when ordering. For technical reasons, the products chosen by the Customer may no longer be available from ANJALI MOONRISE when the order is confirmed. In this case, the Customer will be contacted by Customer Service to find an adequate solution.
The essential characteristics of the items are presented on our site in each of the item sheets in the “shop” section. The images used are not contractual, some differences may be present between the photographs and the real object. Indeed, a photograph is an optical and technical process which can present variations and defects of aspect between the reality and the rendering of the photograph.

 

ARTICLE 4: PRICE


The prices indicated on the site are expressed by default in euros all French taxes included (TTC), on the basis of French value added tax (VAT) at the rate applicable at the time of purchase, excluding transport costs.


ANJALI MOORISE reserves the right to change prices without notice.
The products remain the property of ANJALI MOONRISE until full payment of the price.
The total amount due by the Customer is the amount indicated during the order confirmation.
The total amount of the basket at the "validation of the basket" step is given as an indication, with a predefined delivery method.

The total price will be notified on the order when choosing the delivery method in the "Delivery" step.
The "Payment" step allows you to choose the payment method desired by the Customer, the amount indicated in this step is the total amount of the order including the shipping costs.
Upon receipt of an order confirmation, an order invoice will be available in the "my account" area upon confirmation of the order by the Customer. This will include a summary of the products as well as the total price paid and debited.




ARTICLE 5: PAYMENT


Any item purchased on the site www.ANJALIMOONRISE.fr can be paid by credit card or by stripe.

In case of payment by credit card, the debit is made at the time of validation of the order, after confirmation from the bank issuing the card. In accordance with the recommendation of the CNIL, payments are secured by highly secure pages for entering payment data: card number, expiration date and visual cryptogram (PCI DSS standard). ARTICLE 6: DELIVERY AND SHIPPING


ANJALI MOONRISE delivers the product (s) ordered to the delivery address indicated by the Customer in the “Address” step of his order. It is imperative for the Customer to verify its accuracy. Any reshipment due to an inaccurate address will be the responsibility of the Customer.
Delivery costs are calculated according to the delivery method chosen by the Customer when ordering at the “Delivery” step.


Any order is processed by ANJALI MOONRISE in 3 to 4 working days, the Customer receives an email when shipping his order containing the order tracking number, allowing the customer to locate his package and follow its progress via the carrier site.

The delivery times quoted are indicative.


In mainland France, the delivery time cannot exceed 15 days from receipt of the order confirmation email. The delivery time is approximately 1 to 5 working days. However, ANJALI MOONRISE cannot be held responsible for delays due to the carrier.



ARTICLE 7: RIGHT OF WITHDRAWAL


In accordance with the provisions of article L.121-21, L.121-21-1, L.121-21-2 of the Consumer Code, the customer not satisfied with his order has a withdrawal period of 14 days after receipt of the goods to request a refund and 30 days to proceed with an exchange.


The Customer does not have to provide any particular reason for exercising his right of withdrawal.

To return the products, the Customer must complete the return form to download and print at the following address ?????, he can contact customer service by email at the address anjalimoonrise@gmail.com. The form must be completed with the name, first name, address, order number, as well as the exact list of products to be returned and a full and detailed explanation of the return.


This form will be attached to the package that the Customer will return with the products.
If the Customer decides to return several items of the same order, it is imperative that all products are returned together.

The return costs remain the responsibility of the Customer.

Any returned product must be in its intact condition and unworn in its original packaging. If the returned product is damaged, it will be returned to the Customer at their expense.



ARTICLE 8: RETURNED PRODUCTS


To return a product, you must first contact ANJALI MOONRISE, by email at the address anjalimoonise@gmail.com to indicate the reason for the return. After agreement between the two parties, the Customer must return the product at his expense.


If the return follows an error on the part of ANJALI MOONRISE (reference, size, hidden defect…), ANJALI MOONRISE undertakes to reimburse the delivery costs and to reship a new product at its expense. The Customer may also request a full refund of the product and the delivery costs.

Subject to the agreement of ANJALI MOONRISE, the Customer can choose between an exchange or a refund; the exchange can be on the same product or on a different product. If there is a price difference between the two products, either the Customer will have to pay the difference, or ANJALI MOONRISE will make a credit for the difference.

Any returned product must be in its undamaged, unworn condition and in its original packaging.

If the product concerned does not meet these conditions, the product will be returned to the customer at his expense.

 


ARTICLE 9: GUARANTEE


ANJALI MOONRISE offers you a commercial guarantee of 3 months, it applies to all products.

This warranty is valid in the context of normal use of the product.

The following are excluded from the guarantee: faults resulting from accidents, improper or abusive handling or use (such as shocks, marks of knocks, crushing, exposure to corrosive agents).

On the other hand, any defective parts due to a manufacturing defect duly noted by our Customer Service will be repaired or replaced.


In order for the Customer to benefit from his guarantee, it is necessary that he has the purchase invoice for the product.


Therefore, that the Customer encounters a problem during this warranty period, the Customer must contact customer service at the following address: anjalimoonrise@gmail.com to find out the terms of return and find an adequate solution.
When returning the product by the Customer, it is necessary to protect and carefully place the product (s) in their original packaging to be sent to ANJALIMOONRISE 107 chemin du Canadeau 83330 LE CASTELLET, accompanied by the invoice.



ARTICLE 10: RESPONSIBILITY


ANJALI MOONRISE cannot be held responsible for events preventing the successful completion of the contract and which would be attributable to the customer, to a third party to the contract or to a case of force majeure.

In addition, the information contained in the site may contain technical inaccuracies or errors in translation or typography and www.ANJALIMOONRISE.fr can not be held responsible. The ANJALI MOONRISE brand is not responsible for the use of other sites which customers can access via links on www.ANJALIMOONRISE.fr.

If a condition turns out to be illegal or is considered null, it will not invalidate the other conditions.



ARTICLE 11: APPLICABLE LAW


Sales concluded with ANJALI MOONRISE via the website www.ANJALIMOONRISE.fr are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, all disputes to which this contract may give rise, concerning its validity, interpretation, execution, termination, their consequences and their consequences will be submitted to the competent court in accordance with the rules of jurisdiction of common law.

All names, logos, brands and titles used on this site are registered trademarks or names registered by their owners.

The Customer declares to recognize that any counterfeiting of the brand, designs or other graphics, may be sanctioned by criminal and / or civil sentences at the discretion of ANJALI MOONRISE.



ARTICLE 13: PERSONAL DATA


All the information requested on the site www.ANJALIMOONRISE.fr when ordering, or when subscribing to the newsletter are as follows: names, address, email, telephone number and Customer number.


In addition, certain information will be collected when browsing the site www.ANJALIMOONRISE.fr via cookies (connection cookies).

This personal information is only used within the framework of the exercise of the site www.anjalimoonrise.fr, in order to guarantee a better follow-up of the orders and an improvement of the services. Madame Emmanuelle ENGLER undertakes not to provide this personal information to any third party without the prior consent of the Client.

ARTICLE 14: CUSTOMS


Any order placed on the site and delivered outside mainland France may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. These customs duties and any taxes related to the delivery of an item are the responsibility of the Customer and are his responsibility. ANJALI MOONRISE is not required to verify and inform its Customers of customs duties and applicable taxes. To know them, it is up to the member to obtain information from the competent authorities in his country.
The language of these general conditions of sale is French. This agreement is subject to French law. And in the event of a dispute with a Customer, the French courts will have sole jurisdiction.


PROVISIONS RELATING TO LEGAL GUARANTEES


All Products benefit from legal guarantees, provided that their use has been normal and that the maintenance advice has been followed.

Legal guarantee of compliant delivery

In accordance with Article L217-4 of the Consumer Code, the seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, assembly instructions or installation when this has been charged to it by the contract or has been carried out under its responsibility.

Pursuant to article L217-5 of the Consumer Code, the goods comply with the contract:

  1. If it is suitable for the use usually expected of a similar good and, where applicable:

    • if it corresponds to the description given by the seller and has the qualities that the latter presented to the buyer in the form of a sample or model;

    • if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;

  2. Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Legal guarantee against hidden defects

In accordance with Article 1641 of the Civil Code, the seller is bound by the guarantee due to hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have given a lower price, if he had known them.

In the event of an action under the legal guarantee of conformity:

- The action resulting from the lack of conformity is prescribed by (2) two years from the delivery of the goods (Article L217-12 of the Consumer Code).

- In the event of a lack of conformity, the buyer chooses between repair and replacement of the good.

However, the seller may not proceed according to the buyer's choice if this choice entails a manifestly disproportionate cost compared to the other modality, taking into account the value of the goods or the importance of the defect. He is then required to proceed, unless this is impossible, according to the method not chosen by the buyer. (Article L217-9 of the Consumer Code)

- Conformity defects which appear within (24) twenty-four months from the delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise. (Article L217-7 of the Consumer Code).

The legal guarantee of conformity applies independently of the commercial guarantee granted by ANJALI MOONRISE at the end of article 9 of these general conditions of sale.

In the event of implementation of the guarantee against hidden defects:

- The buyer has the choice of returning the item and having the price returned, or keeping the item and having part of the price returned, as it will be arbitrated by experts (Article 1644 of the Civil Code).

- The action resulting from latent defects must be brought by the purchaser within (2) two years from the discovery of the defect (Article 1648 paragraph 1 of the Civil Code).

In the event of a finding of non-compliance or a defect affecting one or more Product (s) within the aforementioned deadlines, the Purchaser may return the Products to ANJALI MOONRISE at the address ANJALI MOONRISE 107 chemin du Canadeau 83330 LE CASTELLET or contact by email at the following address anjalimoonrise@gmail.com who will confirm the procedure to be followed.

If the aforementioned conditions are met, ANJALI MOONRISE will proceed with the exchange of the Product (s) presenting such defects of conformity or proven defects and the origin of which is indeed attributable to ANJALI MOONRISE or will reimburse the Purchaser the amount of such Product (s), as well as the costs of returning the Products paid by the Purchaser, if applicable.
